PLEASE READ THESE TERMS AND CONDITIONS OF USE CAREFULLY. THESE TERMS AND CONDITIONS MAY HAVE CHANGED SINCE YOUR LAST VISIT TO THIS WEB SITE. BY USING THIS WEB SITE, YOU INDICATE YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS. IF YOU DO NOT ACCEPT THESE TERMS AND CONDITIONS, THEN DO NOT USE THIS WEB SITE.
1. Formation of Contract
1.1. This document states the Terms & Conditions under which Dream Wardrobe ( "us" , "we", "our" or " Dream Wardrobe") agrees to rent garments to its customer ( "you" or "your" or "hirer")
1.2. All garments remain "our" property at all times and are made available for use by the customer only for the duration of the hire period stated on the Online Order form. It is the Hirer’s responsibility to take care of the Dream Wardrobe's garments for the whole period they are in the Hirer’s care.
1.3. Full payment of the hire charges is required (in advance) on the placing of the Order, and the Hirer authorises the Supplier to deduct any such charges directly from the Hirer’s credit or debit card.
The Customer must be:
(a) Legally capable of entering into binding contracts;
(b) At least eighty (18) years old.
The Services include the rental and sale of Products. This Section sets out terms and conditions that apply to your rental or purchase of any Product.
18 Years or Older. Products may be rented or purchased for use by individuals under 18 years of age, but we rent and sell only to adults, who may rent or purchase the Products with a payment card or other approved payment method. By clicking agreeing to these Terms, you represent that you are 18 years or older and that you are authorized to use the chosen payment method (including, without limitation, credit cards) for the purpose of renting or purchasing the Products as described in these Terms.
Limits. You acknowledge and agree that we may place limits on the rental or purchase of Products, including but not limited to restricting orders placed under a single customer account, payment card or billing or shipping address. We reserve the right to limit, cancel or prohibit any rentals or sales of Products for any reason, including but not limited to availability concerns.
Delivery. Your order will arrive, at the address of your choice via DPD or Royal Mail until 6 pm on your scheduled delivery day.
Collections. If you do not pay the amounts you owe to DREAM WARDROBE when due, then DREAM WARDROBE will need to institute collection procedures. You agree to pay DREAM WARDROBE costs of collection, including without limitation reasonable attorneys' fees.
The following additional conditions apply to the rental of any Product.
The rental fee (“Rental Fee”) for the Product will be the total of the rental fee, insurance charges and delivery charges listed on the Site or App for your rental of the Product. When you place your rental order for a Product, you hereby authorize DREAM WARDROBE to charge your payment card for the Rental Fee. DREAM WARDROBE will charge your payment card the amount of the Rental Fee immediately upon your rental order. A reservation of a Product on the Site or App is an order for the rental of that Product, regardless of how far in advance that Product is reserved. In addition, at the time of your rental order for a Product, you hereby authorize DREAM WARDROBE to charge your payment card for an amount equal to 100% of the original retail value of the Product set forth on the Site or App (“Retail Value”) plus applicable sales taxes; provided that DREAM WARDROBE will only charge your payment card for an amount greater than the Rental Fee as described below. Rental Fees include VAT and insurance.
You are responsible for loss, destruction or damage to the garments, such as theft, fire, major stains or any other cause, other than minor stains. Please understand that if the dress is returned with any kind of these irreversible damages, you must pay the full retail price (100% retail price) according to our price list plus late fees if any. If you wish to keep the dress you must pay 100% of retail price.
Under no circumstances are customers to attempt to clean any Garments themselves.
All orders are subject to availability. In the absence or difficulty to supply, Dream Wardrobe reserves the right to inform you of products with equal style, quality and price. You must confirm the new order. Dream Wardrobe will refund you for unworn dresses.
The Dream Wardrobe online product catalogue is liable to change at any time. The characteristics of the products are as described at the time of the hire. All images found on the site are illustrative. Descriptions of the products do not assure conformity or suitability of a product for an exact purpose, neither must be free of any unintentionally errors.
The products listed in the catalogue are available for delivery to the United Kingdom and other European Countries.
The product pricing is as displayed at the time of the hire. The final price may vary according to the country of delivery, shipping costs and legal taxes.
Every dress will be sent in duplicate; two different sizes chosen by the customer. The second size is free of any additional costs. These dresses are sent to the customer with the purpose of offering a 100% fit satisfaction. You should only wear one dress. The customer should keep appropriate size and send back the one you will not wear. If both dress ket for full rental period , you will have to pay two rentals.
You may cancel your rental order subject to the following cancellation fees and policies:
If you cancel thirty (30) or more days in advance of the delivery date, full refund will be issued to the payment card you used for the order.
If you cancel fourteen (14) or fewer days in advance of the delivery date, refund minus £20 cancellation fee will be issued to the payment card.
Return Packaging. With delivery of the Product, DREAM WARDROBE will provide you with pre-addressed carrying case or mailing envelope or a box (as the case may be) as well as instructions for your use in returning the Products to DREAM WARDROBE (“Return Packaging”).
3. Use of the Products. You agree to treat the Products with great care, as if it was borrowed from your close friend. You are responsible for loss, destruction or damage to the Products due to theft, mysterious disappearance, fire, major stains or any other cause, other than normal wear and tear. Normal wear and tear encompasses minor stains, missing beads, stuck zippers or other minor damage covered by the insurance you paid for with your rental of the applicable Product. If you return a Product that is damaged beyond normal wear and tear, then you agree that we shall charge you, and you shall pay, for the price for repairing or replacing the Product, as determined in our discretion 100% Retail Value for the Product.
3.1. No order shall be accepted unless a delivery/event date is stated on the on-line Order Form.
3.2. Deliveries can be made up to 1 working day before an event date.
3.3. There may be additional delays and carriage charges to be added to the Hirer’s order for parts of Northern Ireland, Northern Scotland, Isle of Man, Isle of Wight and South Western Cornwall (the Hirers in these areas must check for additional carriage costs before placing the Hirer’s order). Deliveries will be made between 9am and 5.30pm on the delivery date.
3.4. The Supplier does not accept responsibility for any failure to deliver by any third party carriers; disputes concerning delivery should be taken up with the carrier concerned.
3.5. Hire orders may be extended for additional days at a rate of £30 for each additional day (Hirers must check extended hire charge when placing the Hirer’s order).
3.6. The Supplier will not be liable to the Hirer if the Delivery Date is after the date of delivery required by the Hirer in the Order if such delay was beyond the Supplier’s reasonable control. In the event of such delay the Supplier shall exercise every effort to deliver the goods as soon as reasonably possible.
5.3. The Hirer agrees to notify the Supplier immediately in writing of any loss or damage to the garments once the Hirer becomes aware of such loss or damage and be liable to the Supplier for the full replacement / repair costs of such garments. The Supplier will notify the Hirer of any losses / damage not so notified to the Supplier, and may charge the Hirer the full replacement / repair costs of such garments. The Hirer authorises the Supplier to deduct any such charges directly from the Hirer’s credit or debit card.
5.4. The Hirer will take particular care of top hats, and will never allow top hats to be thrown into the air.
5.5. The Hirer agrees as an obligation surviving termination of this agreement to indemnify the Supplier in respect of any claims made against the Supplier and all damages costs and expenses suffered or incurred by the Supplier as a result of any third party claim arising out of the Hirer’s use of the garments or in any way arising out of the garments being hired to the Hirer under this agreement.
CORRECT PRODUCTS. We will deliver the Products you ordered, including the specified size, color and design, on or before the delivery date for which you ordered them, except in the rare event that the Product is damaged beyond repair or is otherwise unavailable. In such event, we will use reasonable efforts to notify you that the Product is unavailable. If we are unable to reach you, you acknowledge and agree that we may send you a replacement product of the same or greater value. Products may appear different in color and style than as displayed on the Site.
6. Return of Garments
6.1. All garments and accessories must be returned back to us on the last day of rental.
6.2. The Supplier requires that the Hirer retains the consignment note given to the Hirer by the carrier, signed by the Hirer, for up to two months as good evidence that the collection was successful.
6.3. You can book a collection with us free of charge. In the event of a “failed collection” the Hirer will be wholly responsible for contacting the Supplier to make alternative arrangements, and will be liable for any collection costs incurred, and any additional charges for late return (£30 per day after the stated return date). The Hirer authorises the Supplier to deduct any such costs directly from the Hirer’s credit or debit card.
6.4. Late Fees. If you return the Products late or not at all, a late fee of £30.00 will be charged to the payment card you used to pay the Hire Fee or to any other payment card included in your account information that you have provided to Dream Wardrobe for every day that you are late returning the Products, and you agree to pay such late fees, up to an amount not to exceed 200% of the Retail Value plus the Hire Fee.
7. Accidental Damage Waiver
7.1. Other than as covered by the Accidental Damage Waiver outlined below the Supplier reserves the right to charge the Hirer for the full price of any garment following accidental damage or any other loss (beyond normal wear).
7.2. Except for the items listed below (which are NOT covered by this waiver) the Hirer will pay a charge of £12 per garment for Accidental Damage Waiver, by which the Supplier will waive any charges that would normally arise following accidental damage or any other loss (beyond normal wear) to any of the garments used appropriately.
7.3. The waiver does not apply to:
7.3.1. Top Hats;
7.3.2. garments that have, in the Supplier’s reasonable opinion, been damaged through inappropriate use;
7.3.3. any garment and/or accessory lost or stolen;
7.3.4. garment covers, hat boxes and bags.
This contract is governed by English Law and the parties submit any disputes to the jurisdiction of the Courts of England and Wales.
8.00 Cancellation Policy.
8.1 If you tried the dresses on, but none of them fit we will refund your order provided the dresses are posted back not later then next day. Refunds will be issued in a form of a credit note towards future rentals. ( see cancellation policy for each dress when you placing order)
Please Note shipping costs are non-refundable. Items kept for over 24 hours since delivery will not be refunded.
8.2 Return Packaging. With delivery of the Product, Dream Wardrobe will provide you with a pre-addressed carrying case or mailing envelope or box (as the case may be) as well as instructions for your use in returning the Products to Dream Wardrobe (“Return Packaging”). T
Receipt of the Products. Upon delivery, you bear responsibility for the Product(s). You acknowledge that a Secure Shipping Address is highly recommended. A “” means a location where an individual can physically receive Product(s). In the event that an un-secure shipping address is provided, Dream Wardrobe does not bear liability for Products left unattended. Furthermore, you acknowledge that providing anything other than a Secure Shipping Address may result in delivery delays and additional delivery fees for which Dream Wardrobe will not be liable. You will be liable for all such delays and additional delivery fees.
8.4 Use of the Products. You agree to treat the Products with great care, as if it was borrowed from your close friend. Normal wear and tear encompasses minor stains, rips, missing beads, stuck zippers or other minor damage covered by the insurance you paid for with your rental of the applicable Product. If you return a Product that is damaged beyond normal wear and tear, then you agree that we shall charge you, and you shall pay, for the price for repairing or replacing the Product, as determined in our discretion, up to the Retail Value for the Product.
CANCELLING YOUR ORDER FOR PURCHASE OF GOODS
If you are based in the EU under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (ICACRs), you have the right to cancel your order with us provided you give us written notice.
The cancellation period will expire 14 days from the day after the day on which you acquire (or a third party other than a carrier and indicated by you acquires) physical possession of the last of the goods.
[* This period does not apply for rentals and if the consumer has expressly requested that the rental and delivery date is started within the cancellation period, has acknowledged the loss of their cancellation right and has been given the required information.
To exercise the right to cancel, you must inform us by letter to: Notice of Contract Cancellation, Customer Care Department, Dream Wardrobe Unit 5.13, Grand Union Centre, 332 Ladbroke Grove, London W10 5AH, UNITED KINGDOM or by email to: firstname.lastname@example.org You may also use the cancellation form on the website, but it is not obligatory.
We recommend that you insure the return shipment as you are under a duty to take reasonable care of the goods and will be liable for damage to them until we receive them at our warehouse. We also recommend that you use a secure, trackable means to return your order to us at Dream Wardrobe Unit 5.13 , Grand Union Centre, 332 Ladbroke Grove, London W10 5AD London and that you retain proof of sending, in case of a dispute.
Please note that you must cover the cost of the return shipment, as our free collection service does not apply to orders cancelled under the ICACRs.
All items must be returned unused, in their original condition and from the country that the order was delivered to.
10.2. We will refund the full value of your purchased goods only, including standart shipping costs, within 14 days of receiving your notice of contract cancellation.
This does not apply to hired or rented goods.
Please note you may only use your right to cancel the order under the ICACRs if you give us formal written notice of cancellation any time after your order has been placed, up until 14 calendar days from the day after you receive your order, by email or post as described above, i.e. before requesting your RMA.
Finally under the ICACRs, Dream Wardrobe have a right to deduct an amount from the reimbursement (or charge a consumer) if he has diminished the value of the goods by handling them beyond what is necessary to establish their nature, characteristics and function, when a consumer returns a dress, which you can see has clearly been worn. The consumer has not acted reasonably and Dream Wardrobe can make a deduction for diminishing the value.
